The ETS Tick Trader^® Professional Indicator Version 2
for NinjaTrader^© Purchase Agreement and Risk Disclaimer

1. I understand that this is copyrighted, patent-pending materials owned by Traders Education LLC.
2. I understand that I am purchasing either a monthly, annual or permanent License to the ETS Tick Trader^® Professional Indicator Version 2 (specific duration determined at check-out) for use on the NinjaTrader^® platform from Traders Education LLC and that Traders Education LLC grants purchaser a license to use one copy of the version of this software on any one hardware product (personal computer) for as many licenses as you have purchased. The software is owned and copyrighted by Traders Education LLC and purchaser's license confers no title or ownership in the software and should not be construed as a sale of any right in the software.

   I further understand and agree that upon submission of this order I will receive 30 days of access to the ETS Tick Trader^® Professional Indicator Version 2 and I also understand that I am purchasing continued access to the Indicator at the rate of $99.00 per 30-day cycle to be billed at the beginning of each cycle. This access will be billed automatically on a recurring basis, every 30 days, until cancelled by purchaser. All cancellation requests must be forwarded to Monica@EminiTradingStrategies.com within 3 business days of a new 30-day cycle. Monthly access to the Indicator will not be prorated and is non-refundable; no exceptions. It is the purchaser's responsibility to submit all cancellation requests within this time period.
3. I understand that it is my responsibility to provide monica@eminitradingstrategies.com with my NinjaTrader Machine ID in order to activate the Pro Indicator Version 2. This activation may take up to 24 hours to process during the business week and longer on weekends and/or holidays.
4. I understand that this purchase is only for my individual, personal use and I further understand that my license will commence on the date of purchase.
5. I understand that the ETS Tick TraderNinjaTrader^© Professional Indicator Version 2 is designed for use solely on the NinjaTrader^© charting platform and it is therefore my responsibility to obtain either the demo or live version of NinjaTraderNinjaTrader^© in order to facilitate the installation and use of the ETS Tick TraderNinjaTrader^© Professional Indicator Version 2. I further understand that the Indicator will only work on the NinjaTraderNinjaTrader^© charting platform with associated real time "tick" data and all questions pertaining to said platform should be directed to NinjaTraderNinjaTrader^© and not Traders Education LLC or its affiliates or agents.
6. I further understand and agree that as a courtesy, Traders Education, LLC will allow one Machine ID license transfer (the old ID will be deactivated) per calendar year and any subsequent requests will be assessed a $25.00 transfer fee.
7. I understand that the ETS TickTrader^® Professional Indicator Version 2 generates mechanical trading signals and that the signals generated are not investment advice and should not be construed as a recommendation of any kind and I am proceeding on my own accord and take full responsibility for the actions I take on my behalf. I also understand that this is neither a solicitation nor an offer to Buy/Sell securities, futures or options. No representation is being made that any account will or is likely to achieve profits or losses similar to those discussed on this web site. The past performance of any e-mini trading system or methodology is not necessarily indicative of future results. Furthermore, I have read and understand the CFTC Risk Disclaimer, shown below.

9. All rights reserved. No part of the website, software, live chat room (either in written or audio format) or training videos may be reproduced or used in any form, or by any means, graphic, electronic, or mechanical including photocopying, mimeographing, recording, taping or for information storage and retrieval systems, nor may any part of the training materials be programmed for computer use or reversed engineered without expressed written permission from Traders Education LLC.
10. I agree that I will not sell, rent, auction, or teach any material included with this purchase.
11. I agree not to discuss said materials in any message forum (other than our private, member's only forum) or chat room, online or off-line.
12. Traders Education LLC reserves the right to revoke the license granted under this purchase and to initiate legal action against any client who violates the terms and conditions contained in this agreement.
13. I understand and agree that due to the nature of electronic downloading of training videos and/or software, all sales are final, and no requests for refunds or returns will be accepted. Since trading successfully depends on many elements including but not limited to a trading methodology and a trader's own psychology and discipline, Traders Education LLC does not make any representation, warranty or guarantee that the Tick Trader® Day Trading Course will be suitable or profitable for you.
14. I further agree and understand that Traders Education LLC periodically schedules system downtime for maintenance and other purposes. Unplanned system outages may also occur. Traders Education LLC shall have no liability whatsoever for (i) the resulting unavailability of the Site; (ii) any loss of data or transactions caused by planned or unplanned system outages; (iii) the resultant delay, misdelivery or nondelivery of information caused by such system outages, or (iv) any third party acts or any other outages of web host providers or the Internet facilities and network that is external to the Site.
15. I agree to indemnify, and hold Traders Education LLC, and its subsidiaries, affiliates, officers, directors, employees and agents harmless from and against any and all claims, demands, actions, costs, liabilities, losses and damages of any kind (including attorney's fees) resulting from (i) Your use, misuse or abuse of this Site, or (ii) Your use or misuse of any of our Training Materials, Videos, Indicators, Software, Live Chat Room or Member's Forum that may result in a direct or indirect loss or liability.
16. I understand that certain Membership privileges are granted by Traders Education, LLC to individuals exclusively and are granted specifically to the subscribing registered member only. No employee, independent contractor, agent, or affiliate of purchasing member is permitted to access any of the password protected areas of the Traders Education LLC web site without express written permission from Traders Education LLC. All Membership rights conferred under this agreement cannot be assigned, sublicensed, distributed, shared, viewed, accessed, or otherwise transferred to anyone other than the registered member without the express written permission of Traders Education LLC. I further understand that Traders Education LLC reserves the right to refuse service to any member at Traders Education LLC's sole discretion that abuses their rights related to this service. Traders Education LLC reserves the right to amend these Terms of Service at any time and without notice, and it is the purchasing member's responsibility to review these Terms of Service for any changes.
